Zygo Corp. Wins Judgment on Patent Infringement Suit

Zygo Corp. (Middlefield, CT) has received a favorable ruling in a patent infringement lawsuit against defendant Wyko Corp., a unit of Veeco Instruments (Plainview, NY). U.S. District Court (District of Arizona) Senior Judge Justin L. Quackenbush awarded Zygo $1,013,673 by the Court on remand from the Court of Appeals for the Federal Circuit (CAFC) in Washington, D.C., for a recalculation of damages for patent infringement by the defendant. Wyko can appeal the ruling.

"We are pleased with the Court's decision. This decision, together with the previous rulings rendered by the Court in this case, upholds our basic claim that Zygo's patent was infringed by Wyko and that significant damages are due us," stated Bruce Robinson, Zygo president and CEO. "We are pleased that we have been vindicated in our decision to protect an important core technology through a long and arduous process. Zygo considers its intellectual property to be a very valuable asset."

Zygo Corp. designs, develops, manufactures, and markets measurement and yield improvement instruments, custom automation systems, and accessories used in high technology industries.

Veeco Instruments manufactures metrology tools for the data storage and semiconductor industries and process equipment etch and deposition tools for the data storage and opto-telecommunications industries.
